The Equality and Human Rights Commission (the Commission) has a statutory remit to promote and monitor human rights; and to protect, enforce and promote equality across the nine "protected" grounds - age, disability, gender, race, religion and belief, pregnancy and maternity, marriage and civil partnership, sexual orientation and gender reassignment. More specifically, the Commission has a duty under section 8 Equality Act 2006 to promote awareness and understanding of rights under the equality enactments and to encourage good practice. The Commission may publish information or give advice and guidance, or issue statutory codes of practice under sections 13 and 14 of the Equality Act 2006. The Commission has produced Statutory Codes of Practice to accompany the Equality Act 2010 and we now require the provision of legal drafting of technical guidance specifically for the supplement to the Commission’s Code of Practice on Services, Public Functions and Associations (the Services Code) in relation to the ban on age discrimination in services under Equality Act 2010. The guidance will take the form of either a statutory supplement to the existing Code, or a supplement in the form of non-statutory technical guidance. This guidance is primarily aimed at specialist audiences who need to have a clear understanding of what the law says. This guidance will enable courts and tribunals, lawyers and advisers to interpret the law correctly, and also facilitate compliance with the law by explaining to organisations the steps which should be taken to minimise the risk of claims being taken against them.
