Cleveland Fire Brigade (the “Parent Bodyâ€) is seeking to separate out its current roles of commissioning fire and rescue services and the providing of those services itself. Their intention, subject to decisions yet to be taken approving this separation, is to transfer the existing employees who provide fire and rescue services into a staff led Public Service Mutual and social enterprise (the “Potential PSMâ€), while retaining in house the commissioning role (effectively Cleveland Fire and Rescue Authority). In order to achieve the objectives outlined above, and to enable the Potential PSM to spin-out of its Parent Body, there is a need for: • Legal support to advise Cleveland Fire Brigade on the procurement options available to it if it decides to contract out its fire and rescue services; • Legal support to the Cabinet Office (the “Customerâ€) to develop a model contract that can be published and used by Public Service Mutuals that wish to provide fire and rescue services under contract; and, • Legal support to Cleveland Fire Brigade to amend the model contract, in the event that it decides to contract out its fire and rescue services.
